Terms of use
These terms apply to Vantage, Synapse, Slate and Tribulator (the “products”), provided by Hypnos Medical Limited, Wellington, New Zealand (“Hypnos Medical”, “we”). By using a product you agree to these terms. Nexus360 has its own terms and is not covered here. How the products handle information is set out in our privacy policy.
In short
- The products support your clinical judgement and learning; they don’t replace them. Always check doses and clinical information against current guidelines and product information.
- You are responsible for any patient information you enter, and for keeping your own backups and passphrase.
- The products are provided “as is”, and our liability is limited as far as the law allows.
1. Who can use the products
The products are designed for health professionals, and for students and trainees in health disciplines aged 16 or over. If you use them on behalf of an organisation, you confirm you are authorised to accept these terms for it.
2. Clinical use
- Not a substitute for clinical judgement. The products are reference, organisational and educational aids. They do not give medical advice and do not replace your own clinical judgement, training, or local policies.
- Check before you act. Drug doses, calculations and clinical information must be checked against current local guidelines, formularies and product information before use in patient care. Information can be incomplete, out of date or wrong.
- Synapse is a teaching simulation. Its physiology and pharmacology are simplified for teaching and must not be used to guide the care of real patients.
- AI features can be wrong. Details extracted from documents (Slate) and paper summaries or search results (Tribulator) are generated by an AI model and may be inaccurate or incomplete. Check them against the source before relying on them.
- You remain responsible for all clinical decisions you make, whether or not you used a product in making them.
3. Patient information
- Slate lets you record patient information on your device. You are responsible for doing so lawfully, including under the Privacy Act 2020, the Health Information Privacy Code 2020, and your employer’s policies. Slate is a personal work tool, not an official clinical record.
- Don’t enter patient information into Vantage, Synapse or Tribulator. Tribulator’s Google Drive file is not encrypted.
4. Your data and backups
Your data is stored on your device and, if you choose, in your own Google Drive. We don’t hold a copy. You are responsible for keeping backups and for remembering your Slate backup passphrase: if your device is lost or its data is cleared, or you forget your passphrase, we cannot recover your data.
5. Third-party services
Some features rely on services we don’t control, including Google Drive, Anthropic (AI features, using your own API key), PubMed and Crossref. Your use of them is subject to their own terms. You are responsible for any charges from Anthropic for your API key. We aren’t responsible if a third-party service is unavailable, changes, or handles your information in a way you don’t expect.
6. Synapse access codes
- Some Synapse content may require an access code. A code gives access to that content for the period stated when the code is issued, and access ends when that period ends.
- Codes are for the person or group they were issued to. Don’t share a code beyond that group.
- We may withdraw a code so it can no longer be redeemed, for example if it has been shared publicly. Access already granted continues until it expires.
- Payment terms, if any, are agreed when you buy access. Payments are not refundable except where the law requires.
7. Acceptable use
Don’t use the products unlawfully, interfere with their operation or security, overload the services they rely on, or try to get around access codes.
8. Intellectual property
The products and their content belong to Hypnos Medical or its licensors. Some are also published under open licences, for example Vantage content under Creative Commons Attribution-NonCommercial 4.0 and the Synapse source code under the Apache License 2.0. Those licences set out how you may copy and adapt that material; these terms govern your use of the products as we provide them. Linked guidelines and third-party resources belong to their owners.
9. Availability and changes
We may change, suspend or withdraw any product or feature at any time. We aim to keep the products available and accurate, but we don’t guarantee that they will be uninterrupted or error-free.
10. Our liability
- To the extent permitted by law, the products are provided “as is”, without warranties of any kind, and Hypnos Medical is not liable for any loss or harm arising from your use of them, including loss of data and any consequence of clinical decisions.
- If we are found liable despite this, our total liability to you is limited to the amount you paid us for the product concerned in the 12 months before the claim.
- If you use the products for the purposes of a business, including your clinical practice, you agree that the Consumer Guarantees Act 1993 does not apply, as permitted by section 43 of that Act.
- Nothing in these terms limits any right you have under New Zealand law that cannot lawfully be limited or excluded.
11. Changes to these terms
We may update these terms. We’ll post the updated terms on this page and change the effective date above. If you keep using the products after that, the updated terms apply.
12. Governing law
These terms are governed by New Zealand law, and the courts of New Zealand have jurisdiction.
